1. Service

domain.latino is operated by NicNames, Inc., an ICANN-Accredited Registrar. NicNames provides .LATINO Priority Registration Support for eligible trademark owners and a First-Day Registration Attempt service for customers who want a .LATINO name without going through priority. Services include trademark/TMCH eligibility review, lawyer-supported TMCH submission, SMD/digital certificate handling, .LATINO availability and premium check, registrar submission handling, and deadline management. NicNames, Inc. is not the .LATINO registry; .LATINO is operated by DISH gTLD Registry. NicNames acts as a service provider supporting your registration request.

3. Eligibility

Priority .LATINO registration support is intended for owners of registered trademarks whose requested domain matches the textual elements of the trademark and who, where applicable, can obtain or already hold a valid TMCH-issued SMD file. By submitting a request you confirm that you are authorized to act on behalf of the trademark owner and that all information provided is accurate. The First-Day Registration Attempt service is available without a trademark, subject to the rules in section 5.

4. No guarantee of registration

Submission of a request does not reserve or guarantee any .LATINO domain. Final registration depends on trademark eligibility, TMCH/SMD validation, domain availability, registry restrictions, premium/reserved/blocked status, and final registrar/registry approval. We will use commercially reasonable efforts to handle your request within the applicable registry windows.

5. Fees

Service fees published on the pricing page apply unless otherwise quoted in writing:

• Priority Package — $2,500 (USD). Full priority service for trademark owners.
• Priority + existing SMD — $100 (USD) for non-premium names. Premium names: registry retail price only.
• First-Day Registration Attempt — $100 (USD) for non-premium names. Premium names: registry retail price only, no separate deposit.

Premium retail fees are set by DISH gTLD Registry and range from $70 to $28,000 across ten tiers. Premium retail is billed in addition to the priority service tier when applicable. Renewal fees are billed separately when applicable. Final fees for premium, reserved, or blocked names are subject to registry/registrar confirmation.

6. Refunds — 100% credit or 80% cash on unsuccessful registration

If the registration is unsuccessful for any reason — for example, the name was registered in an earlier phase, another registrar was faster on the first day of broader registration, the registry refused the registration, or the name became reserved, blocked, or otherwise unavailable under registry policy — we automatically credit 100% of fees paid to NicNames, Inc. for the affected service to your domain.latino balance. You may apply that credit to any other .LATINO domain on domain.latino, or to any name on NicNames.com (Ukrainian customers). If you prefer cash, you may request an 80% refund to your original payment method instead — the 20% difference covers our processing, TMCH/SMD work, registrar submission attempts, and the per-attempt cost we incur regardless of outcome. Election of credit vs cash refund is at the customer's sole option; we process the chosen path within 14 business days of the unsuccessful-registration determination.

This refund policy applies to all three service tiers (Priority Package, Priority + existing SMD, and First-Day Registration Attempt). Premium retail fees paid to the registry that were not actually charged to the registry on your behalf are refunded in full (100% via credit or cash, regardless of chosen path) alongside the service-tier refund; premium fees already consumed by the registry are non-refundable.

Refunds are issued to the original payment method within 14 business days of NicNames confirming that the registration is unsuccessful. Where eligibility is determined to be impossible before substantive work has been performed, a higher refund may be available at our discretion.

7. No concurrent applications and "Pending" status

Once your payment for a .LATINO name through domain.latino has successfully completed (the card was charged or the wire/crypto invoice was actually received), your application enters Pending status. While your application is Pending, NicNames will not accept any other paid application for the same name through domain.latino. This protects you from paying for a name that another domain.latino customer has already committed to.

An unpaid invoice request, a card that is still being processed by the issuer, or a failed/declined payment does not reserve a name. Other customers can apply for that name during that window. As soon as your payment clears, the name flips to Pending and the public search starts returning Reserved.

If your application is unsuccessful, the name returns to the available pool, your refund (100% credit by default, or 80% cash on request — see section 6) is issued, and other customers can apply for the name through domain.latino.

8. "Reserved" status in our public search

The public availability search on domain.latino queries the registry (RDAP) plus our internal record of paid Pending applications. When a name matches a successfully-paid Pending application, the search returns Reserved rather than Available. This is an internal status — it reflects that the name is under an active paid application at domain.latino; it does not mean the name has been registered with the registry. Other registrars and the public WHOIS/RDAP record will continue to show the name as appropriate for that channel.

9. Auto-transfer to your NicNames.com account

When your .LATINO registration is successful, the domain is placed into a NicNames.com registrar account associated with the same email address you used at domain.latino. NicNames, Inc. is the registrar of record (ICANN-Accredited Registrar IANA ID assigned to NicNames, Inc.); domain.latino is the service portal we run on top of that registrar.

You can create your NicNames.com account at any time at https://nicnames.com/. If you create the NicNames.com account before your registration completes, the successful domain lands directly in your existing account — no extra step. If you don't, we provision an account with your email on first successful registration and email you the activation link.

From your NicNames.com account you can manage DNS, nameservers, contacts, renewals, transfers, and all other registrar operations subject to the .LATINO registry's policies. This domain.latino portal continues to track your order (status, messages, documents); the domain itself lives in the registrar account at NicNames.com.

10. Your responsibilities

You agree to provide accurate trademark information (priority flows), to upload only documents you are authorized to share, and to respond to information requests in time to meet registry deadlines. Missed deadlines caused by delayed responses on your side may prevent registration and may reduce the refund payable under section 6, at our reasonable discretion.

11. Restrictions during limited registration periods

.LATINO may impose additional restrictions during limited registration periods. Some registrations may require payment-related use or eligibility based on registry policy. We will surface known restrictions where possible, but cannot override registry rules.

12. Liability

To the maximum extent permitted by law, our aggregate liability arising out of or in connection with the service is limited to the fees you have paid for the service in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including loss of profits, goodwill, or business opportunity.

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Disputes will be resolved by the competent state or federal courts located in Delaware, without prejudice to mandatory consumer-protection rules in your jurisdiction.
